and one other thing to note ... if you didn't know, the supreme court justices over here.) when a justice retires (or dies):

• STEP 1 - president nominates a prospective justice, and
  
• STEP 2 - the senate holds hearings to confirm or nix the nominee. and only a majority (or 51 votes) is needed. (senate on the nominations)
